These Terms & Conditions ("Terms") govern your access to and use of the Shop By ABS website and your purchase of any products ("Products," "Championship Belts") from us. By accessing our site or placing an order, you ("you," "Customer," "Buyer") agree to be bound by these Terms.
By placing an order, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract. These Terms constitute the entire agreement between you and Shop By ABS concerning your purchase.
Representation: We strive to accurately represent our products through images and descriptions. However, slight variations in color, finish, or detail may occur due to monitor settings, material batches, and the handcrafted nature of our products.
Custom/Bespoke Orders: This section is critical for your business.
Design & Approval: The process for custom belts requires formal approval of a final design proof. You are responsible for reviewing the proof thoroughly. Shop By ABS is not liable for errors in custom text, logos, or design elements once the proof is approved by you.
Manufacturing Commitment: Once a custom order is approved and paid for, production begins immediately. Custom orders are FINAL SALE and cannot be canceled, refunded, or returned unless the product arrives materially different from the approved proof or is defective.
Intellectual Property: You warrant that any logos, artwork, or text you provide for a custom order do not infringe on any third-party rights (trademarks, copyrights). You grant Shop By ABS a limited license to use this IP solely for the purpose of fulfilling your order. Shop By ABS retains all rights to its own proprietary designs, templates, and manufacturing processes.
Order Confirmation: Your order constitutes an offer to purchase. Acceptance occurs when we send an order confirmation email.
Pricing: All prices are in [e.g., US Dollars]. We reserve the right to correct pricing errors at any time. Prices are subject to change without notice.
Payment: Payment is processed securely at checkout via our designated payment gateways (e.g., Stripe, PayPal). Your order will not be processed until payment is received in full.
Shipping Costs & Times: Shipping costs are calculated at checkout. Estimated delivery times are provided but are not guaranteed. We are not liable for delays caused by carriers, customs, or unforeseen events (force majeure).
International Orders: You are solely responsible for any import duties, taxes (VAT, GST), or customs clearance fees levied by your country. Failure to pay these may result in the product being returned or destroyed, for which we cannot issue a refund.
Transfer of Risk: Ownership and risk of loss or damage to the Products pass to you upon our delivery to the shipping carrier.
Standard (Non-Custom) Products: We accept returns of unworn, undamaged, and resalable standard products within 14 days of delivery for a refund of the product price, minus original shipping costs. A restocking fee may apply. Return shipping is the customer's responsibility.
Custom Products: ALL CUSTOM AND BESPOKE ORDERS ARE FINAL SALE AND NON-REFUNDABLE/NON-RETURNABLE, except as stated in the Warranty below.
Warranty: Shop By ABS warrants its Products against defects in materials and workmanship for a period of 90 days from delivery. This warranty does not cover damage from misuse, accident, improper care, or normal wear and tear. To make a warranty claim, contact us with photos and your order number. Our sole obligation is, at our discretion, to repair, replace the defective item, or issue a partial/full refund.
All content on the Shop By ABS website (logos, designs, text, images) is our exclusive property or licensed to us and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission. Purchasing a product does not grant you any rights to our intellectual property beyond ownership of the physical item.
To the fullest extent permitted by law, Shop By ABS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or products. Our total liability for any claim related to a product is limited to the purchase price you paid for that product.
You agree to indemnify and hold harmless Shop By ABS, its owners, and employees from any claims, damages, or expenses arising from your breach of these Terms, your use of the Products, or your violation of any third-party rights (especially regarding IP in custom orders).
Governing Law: These Terms shall be governed by the laws of [Your State/Country, e.g., State of California, USA].
